GENERAL TERMS AND CONDITIONS (GTC)

– BUSINESS PHOTOGRAPHY SERVICES –

These General Terms and Conditions (hereinafter: GTC) contain the rules of the legal relationship, as well as the rights and obligations of the parties, established between Szilvia Mihályi E.V. /sole proprietor/ (hereinafter: Service Provider) and the Customer using the service (hereinafter: Customer).

2. SCOPE OF THIS GTC

The scope of this GTC exclusively covers the ordering and fulfillment of business portrait and image photography services available on the business.mihalyiszilvia.hu website.

3. ORDERING AND CONCLUSION OF THE CONTRACT

3.1. The Customer may request a custom quote from the Service Provider via the contact form on the website or directly by e-mail.

3.2. The contract is concluded when the Customer explicitly accepts and confirms the custom written quote sent by the Service Provider via e-mail in writing (via e-mail).

3.3. By confirming the quote, the Customer requests the Service Provider to begin the necessary preparations (especially booking the appointment and organizing) to fulfill the service.

3.4. In the case of larger orders, custom needs, or longer-term projects, the Parties may conclude a separate written business contract containing terms different from this GTC.

4. PRICING AND PAYMENT TERMS

4.1. To book the photography appointment and location, a deposit equal to 50% of the agreed service fee is payable in advance by bank transfer.

4.2. The Customer is obliged to settle the remaining fee by the day of the photoshoot at the latest, ensuring that the amount is credited to the Service Provider’s bank account, or it can be paid in cash on the day of the photoshoot.

4.3. Invoicing is done electronically via the Számlázz.hu (KBOSS.hu Kft.) system.

4.4. In the case of individual agreements, the Parties may agree on different payment terms.

5. CANCELLATION, MODIFICATION, AND RIGHT OF WITHDRAWAL

5.1. The booked appointment can be modified free of charge up to at least 72 hours before the photoshoot.

5.2. If the cancellation or modification occurs within 72 hours, the Customer is obliged to pay 50% of the service fee.

5.3. If the cancellation occurs within 24 hours, or the Customer does not show up, the full (100%) service fee is payable.

5.4. The paid deposit will be counted towards the penalty amount specified in Section 5.2. In the event of a cancellation arising from the Customer’s sphere of interest, the deposit is non-refundable.

5.5. Based on Government Decree 45/2014 (II. 26.) on contracts concluded between distance parties, the Consumer is entitled to a 14-day right of withdrawal

The Consumer acknowledges that after the complete fulfillment of the service (the realization of the photoshoot), they lose their right of withdrawal.
If the Consumer withdraws after the commencement of the performance but before the time of the photoshoot, they are obliged to reimburse the Service Provider’s verified costs already incurred and related to the fulfillment of the contract, and the cancellation terms of this GTC shall also apply.

6. SELECTION OF IMAGES AND POST-PROCESSING

6.1. Following the photoshoot, the Service Provider will make the raw images available to the Customer in a private online gallery.

6.2. The Service Provider will only process and deliver in final form the images selected by the Customer.

6.3. The delivery of the finalized images will take place within a maximum of 10 working days from the receipt of the selection.

6.4. The images are delivered via an online download link.

6.5. Raw images will not be delivered in any form.

7. COPYRIGHTS AND REFERENCE USAGE

7.1. The copyrights of the images belong to the Service Provider.

7.2. The Customer receives a non-exclusive right of use, unlimited in time and space, for business purposes.

7.3. The resale of the images or their transfer to a third party is prohibited.

7.4. Basic editing of the images (resizing, color correction, applying filters) is permitted, but significant modification of the visual appearance, AI-based transformation, or distortion is prohibited.

7.5. The Service Provider is entitled to use the images as references in their portfolio and social media platforms, provided that the Customer has previously consented to this in writing.

7.6. The Customer declares that they have the necessary consent of the persons featured in the photoshoot.

8. COMPLAINT HANDLING AND LEGAL REMEDIES

8.1. Complaints: mihalyiszilviafoto@gmail.com

8.2. The Service Provider will investigate the complaint within 30 days.

8.3. In the event of a legal dispute, the Consumer may turn to a conciliation board.

9. OTHER PROVISIONS

9.1. The data management rules are contained in a separate Privacy Policy (Adatkezelési Tájékoztató).

9.2. In the event of force majeure (e.g., illness, technical failure, weather conditions, official restrictions), the Service Provider will offer a new appointment.

9.3. If the new appointment is not suitable, the paid deposit will be refunded. Further compensation is excluded.

9.4. This GTC is governed by Hungarian law, in particular the provisions of the Hungarian Civil Code (Ptk.).
